RULES AND REGULATIONS FOR OWNERS, TENANTS AND GUESTS

NOVEMBER 12, 2007

GENERAL
  1. No unit may be rented, leased, exchanged or donated more than twice in any one month.
  2. Owners who offer use of their units as prizes or gifts will also be charged with an OCCUPANCY AND FEE for the month in which it is used. Each Owner must file an APPLICATION FOR OCCUPANCY form with a $50.00 fee each time his unit(s) is occupied by anyone except close family members, such as parents, grandparents, children, grandchildren and siblings. The form and fee must be filed with the Management Company at least one week prior to the date of occupancy. Owners who rent through a Real Estate Agency must make the company aware of these requirements. Beginning July 1, 2008 the OCCUPANCY FEE will be increased to $75.00.
  3. No pets are allowed in units by owners, tenants or guests.
  4. All perimeter doors must be kept locked upon entering or leaving.
  5. The condominium units may be used only as single family residences. Residing tenants and guests shall be limited to six persons. This also applies to the pool, recreation areas, and all other common areas and facilities. (Owners and guests must use discretion and common sense regarding the number of guests allowed to use the common elements.)
  6. Non-residing guests using condominium amenities must be accompanied by the owner or tenant.
  7. No owner or tenant may give away any of the common elements.
  8. Quiet hours are from 10:00 p.m. to 7:00 a.m. No loud or objectionable noises are permitted. Refrain from excesses or noise from radios, stereos or televisions.
  9. The hallways, walkways and/or any other common ways of ingress or egress may not be obstructed. Also, anything that may be considered unsightly or dangerous shall be removed from these areas, such as beach chairs and toys.
  10. Laundry, including garments, beach towels and other items, may not be hung on railings or where they are visible from the outside of the units.
  11. Beach floats, chairs and gas/charcoal grills must be kept in the ground floor storage areas when not in use.
  12. Loitering, running and playing on the walkways, stairs or elevator are prohibited.
  13. Sand should be cleaned off feet and body before entering the stairways, walkways, elevator or pool areas. (A shower has been placed at the northwest side of the building, near the beach, for this purpose.)
  14. Waste that cannot be disposed of in the kitchen garbage disposal, such as bottles, cans, paper, etc. shall be placed in garbage bags, tied shut and deposited in the TRASH CHUTE located at the northeast end of each floor, across from 101 and 201, respectively. (Completely close the TRASH CHUTE DOOR to minimize the fire hazard.)
  15. Waste from construction work and materials, such as cabinets, countertops, flooring, tile, carpeting, trash compactors, garbage disposals, furniture, mattresses, box springs, toilets, sinks, etc. MAY NOT be placed in the large dumpster because the waste company will not take these items. Owners will be held responsible for charges incurred by the special removal of these items.
  16. Charcoal or gas cooking grills ARE NOT PERMITTED on the balconies.
  17. Roller skates, skateboards, in-line skates and bicycles are not to be used on the premises.
  18. Water shall not be kept running for an unreasonable length of time.
  19. Water restrictions imposed by the City of Holmes Beach, Manatee County or the State of Florida shall be observed.
  20. Any damages to common elements by owners, their tenants or their guests will be charged to the owner by the association.
ENTRANCE SECURITY SYSTEM
  1. Scroll the name or unit number you want, then press the # key, to ring the unit desired.
  2. The person receiving the telephone call then presses the ‘9’ key on their phone to open the lock on the door. A buzzing sound signals the unlocking of the door. The door remains unlocked for 30 seconds during which the person can gain entry. There is no need to hold the ‘9’ key down on the phone, once it has been pressed.
FIRE PROTECTION SYSTEM
  1. Smoke detectors have been installed in each unit. The owner has the responsibility to see that the smoke detector is operable. The condo fire alarm system has a sounding device in each unit in case an alarm is pulled.
  2. There are five pull switches in the hallways. Owners, tenants and guests should familiarize themselves with these locations.
  3. The elevator SHOULD NOT be used in case of fire.
PHONE 911 FOR EMERGENCIES

The Manatee County emergency system can be reached by dialing 911 on the telephone if police, fire or medical aid is needed. An emergency telephone has also been installed at the pool for pool emergencies.

PARKING
  1. Each owner, tenant, and guest must use the Sun Plaza West Parking Sticker or a Sun Plaza West Rear-View Mirror Parking Hanger to use the Sun Plaza West parking lots/areas. These can be obtained from the Manager or the SPW monitors.
  2. Assigned parking has been marked for each unit. Owners and tenants shall park in these assigned spaces.
  3. Guests shall park in guess parking spaces.
  4. Owners, having more than one car on site, must park the second car in guest parking.
  5. Guest parking may fill up at times. When this happens the Manager or the Monitors may assign guests to temporarily park in assigned spaces that are not being used. The overflow parking lot is located at the south side of the pool and it may be used for guests.
  6. Guests may not use assigned parking spaces without the permission of the Manager or the Monitors.
  7. Motor homes, trailers and boats in tow MAY NOT be parked in any of the assigned parking spaces or in any of the guest spaces under the building or the guest spaces at the front entrance. These vehicles may be parked in the guest spaces south of the pool. The Manager or Monitors must be advised about vehicles parking in the pool area, or the vehicle may be towed at the owner’s expense.
  8. The handicapped parking space is for loading and unloading only since more than one handicapped person may be on site.
  9. Parking will be a problem, if owners, tenants and guests are not considerate of one another and don’t follow the rules listed above.
TENNIS COURT RULES
  1. Players must reserve playing time by using the sign-up board on the tennis court fence.
  2. Playing hours are: 8:00 a.m. to 10:00 p.m.
  3. Players may play for one hour per condo unit while players are waiting.
  4. Owners, and tenants and guests accompanied by owners or tenants may use the court.
  5. Players must use tennis shoes on the court.
  6. Players may not bring food or drinks on the court.
  7. Players must remove all litter before leaving the court.
  8. Players must close gates and turn lights off when leaving the court.
  9. Players are to observe the rules of etiquette for tennis at all times when playing.
  10. Players may not shout, engage in horseplay or damage the net or fence when playing.
  11. Players are limited to a maximum of four on the court at one time.
POOL RULES
  1. Pool hours:
  2. a. When pool cover is being used, the pool hours are from 8:00 a.m. to 6:00 p.m. b. When pool cover is not being used, the pool hours are from 8:00 a.m. to 10:00 p.m.
  3. The pool is for the use of owners, tenants and guests while in RESIDENCE.
  4. Children under the age of 14 must be accompanied by a parent or some other adult.
  5. Infants in diapers may not use the pool.
  6. Pool users are to shower before using the pool to remove sand and/or suntan oil or lotion.
  7. Pool users shall cover their chairs or chaise lounges with a towel for sanitary purposes and to protect the furniture.
  8. Pool users are not be bring or eat food or drink beverages in the pool or on the pool deck.
  9. Pool users are not to use alcoholic beverages in the pool or on the pool deck.
  10. Pool users are not permitted to use large flotation devices in the pool or on the pool deck because of pool area size constraints.
  11. Pool users may use “water wings” for small children and “noodles” for children and adults.
  12. Pool users must be aware that there is no lifeguard on duty at any time. Pool users use the pool at their own risk.
  13. Pool users are informed that DIVING IS STRICTYLY PROHIBITED because of the small size and shallowness of the pool.
  14. Pool users are not to bring any dishes, glassware or cans to pool area.
  15. Pool users must close the table umbrellas when leaving pool area.
  16. Pool users may not bring radios or televisions to pool area. (The exception would be a walkman radio with earphones.)
  17. Pool users may not run on pool deck.
  18. Pool chairs and lounges MAY NOT BE RESERVED and MAY NOT BE REMOVE FROM THE POOL AREA.
  19. Pool users MUST KEEP SAFETY ROPE IN PLACE WHILE CHILDREN ARE IN POOL.
  20. SMOKING IS PROHIBITED IN POOL AND PATIO AREAS.
RESTROOMS

Restrooms are provided for the convenience of pool, patio and tennis users. Please keep these clean.

GATE

The gate to the swimming pool/patio/tennis court must be kept locked at all times. When the pool cover is in place, the Florida Health Department requires that the gate be padlocked for safety reasons.

SAUNAS
  1. Saunas may not be used by children under the age of 14 without adult supervision.
  2. Sauna heaters must be shut off when leaving the saunas.
  3. Do not leave personal items in saunas.
PRIVATE PARTIES
  1. Tenants and/or guests may not use the clubhouse/pool/patio areas for private parties.
  2. Owners and long term tenants (6 months and longer) may use the clubhouse/pool/patio areas for private parties with permission of the Association Officers. Permission must be sought at least one week in advance of the event.
  3. The pool must remain open for owners, tenants and guests during these private parties if the parties occur during hours that the pool is open.
  4. The SPWCA, Inc. may use the patio/pool areas for association business and parties are desired.
  5. The number of gueses at private parties must be limited because there are limited parking spaces at Sun Plaza West.
  6. These private parties may not be used for commercial purposes.

*All common areas and facilities are for the use of all. Courtesy and good sense will make the stays of owners and guests more enjoyable.
